Terms of Service

These Terms govern your use of prime-longevity.com and every service supplied through it. Please read them with the Privacy Policy and the Refund & Cancellation Policy.

1. Who we are and acceptance

These Terms of Service (“Terms”) govern access to prime-longevity.com, the PRIME Movement Assessment™, the PRIME LONGEVITY PROFILE™, the PRIME LONGEVITY ROADMAP™, the PRIME Longevity Blueprint™ and any related educational materials or services (collectively, the “Services”). The Services are supplied by William J. Powell, a South African sole proprietor trading as PRIME LONGEVITY™ (“PRIME”, “we”, “us” or “our”).

By using the website, creating a booking, making payment or accessing a Service, you agree to these Terms and the separate Privacy Policy and Refund & Cancellation Policy. If you do not agree, do not purchase or use the Services.

2. Eligibility and territory

  • You must be at least 18 years old and legally capable of entering into a contract.
  • You must provide your current country and, where applicable, state or province of residence and the location from which you attend a live session.
  • We may decline, restrict or stop a Service where local law, professional rules, safety considerations, sanctions, payment restrictions or our insurance arrangements make delivery inappropriate.
  • You are responsible for checking whether participation in a general wellness and exercise-education service is lawful and suitable where you are located. This does not remove any duty that the law places on PRIME.

3. Wellness and educational scope

Scope statement: PRIME is an online movement-health, healthy-ageing and exercise-education service. For international clients in jurisdictions where the provider is not licensed, the Services are not physiotherapy, physical therapy, telemedicine, medical care, diagnosis, treatment or rehabilitation.

  • A PRIME Movement Assessment™ is a wellness-focused functional movement review. It is not a medical examination, medical clearance or diagnostic assessment.
  • A Blueprint or other programme provides educational exercise and wellness guidance based on information you supply, your goals and observed functional capacity. It is not a clinical prescription for an injury, disease or medical condition.
  • No practitioner–patient or doctor–patient relationship is created merely by your use of the website or Services.
  • The provider’s professional background may be disclosed accurately, but this does not create licensure in your jurisdiction or convert the international Service into local regulated healthcare.

4. Safety and emergencies

You must answer screening questions honestly and promptly disclose pain, falls, dizziness, fainting, chest symptoms, pregnancy, recent surgery, a diagnosed condition, medication changes or any other information relevant to safe participation. PRIME may pause or modify the Service and recommend that you consult a locally licensed healthcare professional.

Stop exercising and seek urgent local medical help if you experience chest pain, severe shortness of breath, fainting, sudden weakness, a severe allergic reaction or another emergency symptom. PRIME does not provide emergency services. In an emergency, contact your local emergency number.

5. Your responsibilities

  • Provide accurate, current and complete information and update it when circumstances change.
  • Use a safe exercise area, suitable footwear and equipment, and follow all safety instructions.
  • Exercise within your ability and stop if an activity causes concerning symptoms.
  • Do not share access credentials, paid materials, video links or personalised programme content.
  • Do not record a live session without prior written permission.

6. Services and fulfilment

6.1 PRIME Movement Assessment™

The Assessment is a scheduled live online session of approximately 45–60 minutes, followed by the deliverables described on the checkout or product page. You need a suitable device, stable internet connection, camera, audio and adequate space. A material technical failure on PRIME’s side will be rescheduled without charge or refunded if a suitable replacement cannot be agreed.

6.2 PRIME Longevity Blueprint™

The Blueprint is a 12-week educational movement and exercise programme with the features described at purchase. Delivery may include personalised digital content, scheduled check-ins and access links. The stated programme period does not guarantee any specific physical or health result.

6.3 Changes

We may make reasonable non-material updates to content, sequencing, technology or presentation. If we make a material change that substantially reduces a paid Service before it is delivered, you may choose an appropriate replacement or a refund for the undelivered portion, subject to applicable law.

7. Prices, payment and tax

Current launch prices are R2,100 for the PRIME Movement Assessment™ and R5,700 for the PRIME Longevity Blueprint™. USD amounts displayed on the website are reference prices only unless the checkout expressly states otherwise. Paystack processes the actual charge in South African rand (ZAR). Your card issuer may apply currency conversion, foreign-transaction or bank fees, which are outside PRIME’s control.

Payment must clear before a booking is confirmed or digital access is supplied. Prices include or exclude VAT only as stated at checkout. You authorise the payment provider to process your payment information under its own terms and privacy practices. PRIME does not store complete card details.

8. Assessment-to-Blueprint enrolment credit

  • An eligible client who completes a paid PRIME Movement Assessment™ receives an R800 credit toward one PRIME Longevity Blueprint™ if enrolment and payment occur within seven calendar days after completion of the Assessment.
  • The resulting Blueprint amount is R4,900.
  • The credit is promotional value only: it is non-transferable, cannot be redeemed for cash, cannot be combined with another offer unless stated, and expires automatically after the seven-day period.
  • The credit is not available if the Assessment payment is refunded, reversed, charged back or disputed. If a Blueprint payment is refunded, the credit has no cash value and is not included in the refund.

9. Bookings, cancellations and refunds

The Refund & Cancellation Policy forms part of these Terms. Nothing in either document limits a right or remedy that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or another applicable consumer law.

10. Intellectual property and permitted use

PRIME and its licensors retain all rights in the website, branding, assessments, scoring systems, reports, programmes, videos, text, graphics and other materials. Following full payment, you receive a limited, personal, non-exclusive, non-transferable and revocable licence to use supplied materials for your own non-commercial wellness and exercise purposes. You may not copy, publish, sell, sublicense, distribute, upload, teach from, reverse engineer or create derivative commercial products from the materials without written permission.

11. Privacy and communications

We process personal information as explained in the Privacy Policy. Because movement screening may reveal health-related information, please provide only information reasonably needed for the Service. Transactional messages about payment, booking, safety and programme delivery are part of the Service. Marketing messages require a lawful basis and must include a practical opt-out.

12. Technology and third-party services

The Services may depend on Paystack, email, video-conferencing, booking, cloud-storage or other third-party providers. Their services may have separate terms. We take reasonable steps to maintain access but cannot promise uninterrupted or error-free availability. We are not responsible for failures outside our reasonable control, subject to mandatory law.

13. No guarantees

Outcomes differ between individuals and depend on participation, health, environment and other factors. Testimonials and examples do not guarantee results. To the extent permitted by law, the Services are supplied on the basis of the descriptions and express commitments stated at purchase, without additional warranties that may lawfully be excluded.

14. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from gross negligence where applicable, or any mandatory consumer remedy. To the maximum extent permitted by law, PRIME is not liable for indirect, incidental, special or consequential loss, loss of profits, loss of data or loss caused by inaccurate or withheld information, unsafe surroundings, use contrary to instructions, or a third-party platform failure. Where liability may lawfully be limited, PRIME’s aggregate liability arising from a particular paid Service will not exceed the amount you paid for that Service.

15. Suspension and termination

We may suspend or terminate access for non-payment, unlawful conduct, abuse, harassment, unsafe participation, material breach, unauthorised sharing or a serious risk to any person. Where reasonably possible, we will explain the reason and allow a proportionate opportunity to remedy the breach. Refunds, if any, will be determined under the Refund & Cancellation Policy and mandatory law.

16. Complaints and disputes

Please send a complaint to hello@prime-longevity.com with your name, transaction reference, the relevant Service and the outcome requested. We aim to acknowledge complaints within two business days and provide a substantive response within ten business days. This internal process does not prevent you from using any regulator, ombud, court or consumer remedy available to you.

17. Governing law

These Terms are governed by the laws of the Republic of South Africa. Subject to any mandatory right to bring a claim elsewhere, the courts of South Africa have jurisdiction. If you are a consumer outside South Africa, you retain any mandatory protections of your country that lawfully apply and cannot be waived by contract.

18. General

If a provision is unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remainder will continue. A failure to enforce a right is not a waiver. We may update these Terms prospectively; the version accepted at purchase ordinarily governs that purchase, except where a legal or safety change must apply sooner. We may not transfer your obligations without notice where the law requires it. Headings are for convenience only.
